The SwissCham Legal Committee is launching a new event series featuring engaging webinars designed to inform companies through real-life cases, practical applications, and useful tips to help our community navigate today's legal landscape and stay ahead of trends that may impact business operations. The pilot episode, hosted on April 22 by Shaohe Law Firm, was a great success—bringing together manufacturers for an insightful presentation and lively Q&A on the topic of PPIL.

    Guo Cai

    Managing Partner at Jin Mao (Beijing) Law Firm

    Ms. CAI Guo started her dispute resolution practice in the public international law sector, as a member of the Khmer Rouge Trial Monitor Team and intern for the International Criminal Court and ICTY. While studying at the University of Hong Kong, Ms. Cai provided pro bono legal assistance to refugees and asylum seekers. The unique multicultural diversity that defines the very beginning of her career continues to influence Ms. Cai's world views and enables her to solve cross-border disputes with cultural fluency and collaborate seamlessly across jurisdictions with ease.

    In 2022, Ms. Cai successfully represented a foreign national in a labor dispute that went all the way to the Chinese Supreme Court, which eventually endorsed Ms. Cai’s argument regarding a novel, unsettled legal issue. The case was subsequently elected by the Supreme Court as one of the six “Guidance Cases” in 2022 concerning judicial supervision of arbitral awards(涉仲裁司法审查指导性案例, Guidance Case No. 201)that provided uniform rules to similar cases across China. The case was awarded by the China Business Law Journal as the “Deal of the Year (Dispute Resolution)” in 2022.

    Since 2021 Ms. CAI has been listed in the “Who’s Who Legal” and “Client Choice Awards” in a row. Starting from fall 2024, Ms. Cai partnered with Harvard Law School’s Sports Law Clinic and mentored student externs with an interest in sports law and China-related legal issues.

    蔡果律师在争端解决领域的经验开启于国际公法领域,自中国政法大学本科毕业随即加入加州大学伯克力分校战争罪研究中心观摩小组,评述柬埔寨红色高棉审判,并于国际刑事法院(ICC)及联合国前南问题国际法庭(ICTY)实习。在香港大学攻读人权法硕士期间,蔡律师为难民和寻求庇护者提供无偿法律援助。独特的多元文化背景定义了她职业生涯的初期,持续影响着蔡律师的世界观,使她能够在不同文化间流畅游走,并灵活利用文化敏感优势洞察文化差异,实现不同司法管辖区的无缝协作以成功解决跨境争议。

    2018-2022年,蔡律师代表一名外籍在华务工人士处理一起劳资纠纷并成功实现客户全部诉求。该案被层报至中国最高法院,最高法院最终认可了蔡律师关于一个前沿、悬而未决法律问题的论点。该案随后被最高法院评选为2022年六件仲裁司法审查指导性案例之一(最高人民法院指导性案例第201号),为全国同类案件树立了统一适用规则。该案被《商法》杂志评为2022年度“年度最佳交易(争议解决)”。

    自2021年起,蔡律师连年入选国际知名法律索引“法律名人录”和“客户选择奖”。从2024年秋季开始,蔡律师与哈佛大学法学院体育法诊所合作,通过实案指导该校选送的、对体育法和中国相关法律问题感兴趣的在校学生。

After studying law at Ludwig Maximilian University in Munich and passing his second state law examination, Ralph Koppitz studied Mandarin Chinese at Beijing Normal University as part of the DAAD scholarship programme ‘Language and Practice in China’.
